Things People Often Ask
Do I need a lawyer to make a will in Malaysia?
You are not legally required to use a lawyer to draft a will under the Wills Act 1959, but working with a qualified advocate helps ensure the document is properly worded, witnessed, and likely to hold up without question. A poorly drafted will can lead to delay or dispute for the people you leave behind.
How long does estate administration usually take?
It varies depending on the size of the estate, whether there is a valid will, and whether all parties are cooperative. Simple estates with a clear will may be settled within a few months. Larger or more complex estates — particularly those involving property in Sabah or disputes among beneficiaries — can take longer. We will give you a realistic picture of timing once we have reviewed the particulars.
What happens if a family member contests the will?
A family member may apply to court to challenge a will on a number of grounds — for example, questioning the deceased's mental capacity at the time of signing, or alleging undue influence. If you are facing such a situation, our dispute support service can help you understand your position and explore whether an agreed resolution is possible before any court proceedings become necessary.
What are your fees, and how are they charged?
Will drafting starts from RM 200, estate administration from RM 625, and inheritance dispute support from RM 405. We explain our fees fully before any work begins, so there are no surprises. Complex matters may involve additional costs, and we will always discuss these with you first.
Is what I share with you kept confidential?
Yes. Legal professional privilege applies to communications between an advocate and client in Malaysia. Information you share with us in the course of seeking legal advice is kept strictly confidential and cannot be disclosed without your consent, except in very limited circumstances defined by law.
Can I update my will after it has been signed?
Yes, a will can be changed at any time while you have mental capacity to do so. Changes are typically made by way of a codicil — a formal supplement — or by drafting an entirely new will that revokes the previous one. We can advise you on which approach suits your circumstances.
